Usage
Policies
The Internet is intended for use by mature
adults (and by minors when supervised by mature
adults). Our customers are expected to use the
Internet with respect, courtesy, and
responsibility, giving due regard to the rights
of other Internet users. The customer is
expected to have a basic knowledge of how the
Internet functions, the types of use which are
generally acceptable, and the types of use which
are to be avoided.
Common sense is the best guide as to what is
considered acceptable use. The following are
unacceptable uses:
Illegality in any form,
including but not limited to activities such as
unauthorized distribution or copying of
copyrighted software, violation of U.S. export
restrictions, harassment, fraud, trafficking in
obscene material, drug dealing, and other
illegal activities.
Net abuse,
including but not limited to activities such as
using a non-existent email return address on a
commercial solicitation, spamming (sending
unsolicited advertising to numerous email
addresses or newsgroups and/or generating a
significantly higher volume of outgoing email
than a normal user), trolling (posting
outrageous messages to generate numerous
responses), mail-bombing (sending multiple
messages without significant new content to the
same user), subscribing someone else to a
mailing list without that person's permission,
cross-posting articles to an excessive number of
newsgroups, or attempting without authorization
to enter into a secured computer system. BME
reserves the right to determine what constitutes
net abuse.
Tortuous conduct,
including but not limited to posting of
defamatory, scandalous, or private information
about a person without their consent,
intentionally inflicting emotional distress, or
violating trademarks, copyrights, or other
intellectual property rights.
Misuse of system resources,
including but not limited to employing posts or
programs which consume excessive CPU time or
storage space; permitting use of mail services,
mail forwarding capabilities, POP accounts.
Design
Support Policies
Time Usage, each
Web Design & Hosting Package is given a specific
allotment of time each month. This design time
does not accrue, if left unused it expires at
the end of each month. If during a requested
support time it appears you will exceed your
support time you (the customer) will be notified
as well as quoted as to what it will take to
complete the task, you confirm the extra time
before it can be billed.. Additional design
support hours are available at the flat rate of
$50.00 per hour.
Design
Support Allocation, design requests are
handled on a first come first serve basis -
average turn about time is just a few days
depending upon the scope of the project.
Limitations of Design Support, BME will not use
design time support to develop a customers
website that is hosted with another company. All
materials must be submitted to BME prior to work
start and position allocation within scheduled
projects. There is a numeric limit regarding
times a month that a customer may request to use
their support time, support time is used in 15
minute increments and each request/project will
deduct from the monthly allowance. All
accounts must be in good financial standings in
order to receive support time, delinquent
accounts over 45 days will be denied until their
account becomes current.
Accounting/Billing
Policies
Billing Cycle and Payment,
BME sends out invoices on a monthly basis via
our electronic bill system. Terms on most
accounts are 30 days unless arrangements have
been made prior to the current billing cycle.
Payments should arrive on or before the due
date, failure to do so will result in a $5.00
delinquency fee, BME also reserves the right to
suspend any past due account until the account
is made current or proof of payment has been
received. BME accepts payments by check
or credit card. Although you may request to make
payment by check a credit card will be required
for security and your deposit.
Defaulting
On Your Account, the customer understands
that if he/she does not communicate in some
fashion (phone, email, or fax) with BME for a
period over 60 days that BME will consider you
to have defaulted on your project/account. Upon
this declaration of default you automatically
grant The Ezekiel Group the right to
charge your credit card for the balance of the
project/account at that time including but not
limited to design fees, incurred expenses, and
past due balances.
Cancellations, we require a 30 day notice
for cancellation, during this period all facets
of site/sever operation will remain in full
operation, this does include billing. All
invoices must be current and in good standing.
Customer is responsible for site content and all
InterNIC issues that may be involved. BME
reserves the right to cancel any account for any
reason with due notice to the customer with the
exception of any violation of the AUP.
